Emil J. Ali and the team at McCabe & Ali, LLP provide legal representation of patent and trademark attorneys in professional conduct investigations and enforcement actions initiated by the United States Patent and Trademark Office (USPTO), Office of Enrollment and Discipline (OED).


Mr. Ali formerly investigated and assisted in the prosecution of attorney misconduct at the OED and helped to promulgate the USPTO Rules of Professional Conduct. Mr. Ali is also a registered patent attorney. As the one of the only former OED attorneys actively representing clients before OED, his unique experience affords him a unique understanding of the regulation of IP professionals. Mr. Ali has handled cases ranging from invention promotion companies to allegations of neglect and conflicts of interest. Mr. Ali is also available to assist applicants for admission in moral character and technical evaluations, limited recognition petitions, show cause orders, petitions to the Director, as well as assisting disciplined practitioners with reinstatement petitions.

Mr. Ali also routinely presents CLEs to bar associations as well as law firms to help improve compliance with the various ethics rules, and to avoid OED complaints. Mr. Ali is also an adjunct professor of law at Lewis and Clark Law School in Portland, OR where he teaches legal ethics. Mr. Ali is also involved in improving the legal profession. His passions include advocacy in favor of proactive management-based regulation (PMBR), and he is active in the American Bar Association Center for Professional Responsibility.
